These Terms of Use are an agreement (the “Agreement”) between Brain Teck (the “Organization,” “we” or “us”) and you ("you" or "User"). This Agreement sets forth the legal terms and conditions governing your use of this website and each Independent Associate’s Platform and each Web Property (collectively referred to herein as the "Site") and for your purchase and/or use of any Brain Teck goods and/or services. This Agreement also provides information on how to become an Independent Brain Teck Associate.

Brain Teck hereby notifies all Associates/Viewers/Customers that the organization is into VFX Effects on movies & web series and it has set a strong marketing base through its Independent Associates by “word of mouth”, “direct one to one” marketing system and not through any e-commerce channels. Brain Teck has its websites (www.brainteck.com) for the marketing of its business and associations and doesn’t authorize any other website/person to list its products in any other channel/online platform. The purchase of products through such an unauthorized platform shall not entitle you to get benefits. Please note that Brain Teck is not in any way responsible and/or liable for the actions of either the wrongdoers and/or their victims in any manner, whatsoever, at any time.

The Company is inter-alia into the business of direct association of various programs. The Company does appoint freelance Independent Associates across the country for marketing its programs. Interested individuals/body corporate can associate with the program after being satisfied with the Business quality and services. They can become an Independent Associate (hereinafter may be referred to as “Group Affialator/independent or Commercial Corporate) of the organization. If they wish, they can apply for the same in the prescribed form and thereby accepting the Terms and Conditions mentioned. Brain Teck doesn’t collect any Registration Charges and is FREE AND EASY to get enrolled as a Customer/Registered Associate. Before filling the application form, the intending Associate is advised to go through the terms and conditions mentioned below thoroughly along with those mentioned in the official website of the company. While placing a project subject to such terms and conditions shall append their signature by way of making a tick in the column provided as a token of their acceptance of the terms and conditions mentioned therein.

Understanding of the Contract

A. Privileges of Independent Associates

The Organization upon scrutiny and verification of the Application may consider the Applicant as an "Independent Associate” for the farm marketed by the Organizer. Independent Associate shall enjoy the following privileges after such recognition:

No territorial restriction to promote the business and to make associates to the company but he/she should be the age of 18 plus.
The organization shall maintain the business account of the Independent Associates and shall be made available for viewing through the Organization website.
A ‘Unique ID’ and ‘Password’ shall be awarded to facilitate viewing of their respective business account.
There shall be no specific targets; however, earnings shall be in proportion to the volume of sales done by the Independent Associates by self or through the team as stipulated.
Associationship may be awarded as a privileged consumer with no deposit, but subject to accepting terms and other conditions.
Associationship is awarded without any commitment/or promise from the company in terms of possible earning potentials.

B. Covenant of Independent Associates

The Independent Associates, upon appending his signature by way of marking a tick on the Terms and Conditions and upon confirming through online in the Organization’s official website, shall be deemed to have accepted the trading as an Independent Associate and hereby covenants as under:

That he/she has clearly understood the Business Opportunity, marketing program, the compensation plan, its limitations, and conditions, and he/she is not relying upon any representation or promises that are not set out in this term and conditions or other officially printed or published materials of the organization.
Shall act as an independent body and shall not commit any misfeasance or malfeasance to create any liability/obligation over the organization of whatsoever nature.
An Independent Associate is not an Agent/Employee or any other Legal representative of the organization or its service providers.
She/he has attained the age of majority and is competent to enter into a contract as provided in necessary proof thereof shall be submitted as and when required by the organization.
Independent Associates hereby undertakes not to accept cash from any new consumer introduced by him/her for joining the programs and discourage his/her team members from accepting cash from any Associates.
The Investment Amount is non-refundable nor Transferable. I (you/associate) accepted this Investment is my own risk and not refundable from the organization.

2. General Terms

Independent Associate may refer to new customers through the ‘Customer Registration Process’. However, these customers will not exist in the Business Opportunity system (genealogy/distributor) network. The customers joining program will be on their choice at the given investment options; respective will be accounted as of their introducing associate. The consumer is not entitled to any Facilitation Income or monetary benefits from the company, but they will have all rights as a consumer and privileges being a registered consumer.
If you have registered FREE and did not activate any package, ID will be DEACTIVATED on the 30th Day from the Registration Date.
The Independent Associate will be eligible towards facilitation or income, as per the volume of refers program/business done by him/her, subject to the eligibility norms formulated by the company from time to time. The company does not guarantee/assure any facilitation fees or income to the distributor on account of becoming just a mere “associate" of the Organization.
The unique ID has to be quoted by the associate in all his transactions and correspondence with the Organization. The Unique ID once chosen cannot be altered at any point of time.
No communication will be entertained without unique ID and basic information if he/she is contacting the organization other than logging in online. The associate shall preserve the ID properly as it is before logging on to the website.
Admin or any other applicable charges will be deducted by the Company as per the prevailing norms at the time of making payment.
Independent Associates undertake to adhere to policies, procedures, rules & regulations formed by the organization.
The associates shall be faithful to the organization and its co-associates and shall uphold the integrity and decorum of the organization and shall maintain good relations with other associates and other clients. The Associate understands that the company shall be at liberty to accept or reject his application to become an associate.
The Company reserves its right to modify the terms and conditions, programs, plans, business and policies with/without giving prior notice. Such notice may be published through the official website of the organization, and any such modification/amendment shall be applicable and binding upon the Distributor from the date of such publication.

3. Investment/Prices

The joining of the investment will be only in the form of Online in form of $(Dollar). And return also will be in the form of Online Transfer in form of $(Dollar) with the Value of his/her earning.
It is mutually agreed between the parties that the Candidate/Independent Associate if satisfied with the program, ensures that the amount towards such an investment option should reach the Organization within 30 days from the date of joining the same. In case the Candidate fails to make payment within the aforesaid 30 days period to the company, it is up to the company's discretion either to accept the payment on the norms prevailing at that point of time or that this Agreement stands terminated and will be deemed as null and void.
It is mutually agreed between the parties hereto, that the organization is at liberty to change/modify the quantum of program cost payable under this Agreement in future or provide for additional Program / Services at such additional cost as may be determined by the organization.
The investment option and specification is also subject to change and may vary from time to time.
The company will not be responsible for any loss or damages if caused due to any technical error in the web links provided on the website, payment gateway, typographical errors, etc.

4. Prohibitions

The Associate is prohibited from listing, marketing, advertising, promoting, discussing, or the business opportunity on any website or online forum that offers like auction as a mode of selling. Please refer to the code of conduct of our Associates Policies and Procedures for complete details.
Once an Associate is terminated, he/she cannot enter into any of the organization premises/meeting locations and his facilitation fee, his/her name would be removed, and he/she would not be entitled to receiving any fees further.
The Associate hereby undertakes not to compel or induce or mislead any person with any false statement/promise to join programs from the organization or to become an associate of the organization.

5. Confidentiality & Duty

Associate/Candidates shall maintain confidentiality with respect to the organization’s information including the organization’s policies, program details, facilitation fees, etc.

6. Force Majeure

The Organization shall not be liable for any failure to perform its obligations where such failure has resulted due to Acts of Nature (including fire, flood, earthquake, storm, hurricane or other natural disasters), war, invasion, act of foreign enemies, hostilities (whether war is declared or not), civil war, rebellion, revolution, insurrection, military or usurped power or confiscation, terrorist activities, nationalization, government sanction, blockage, embargo, labor dispute, strike, lockout or interruption or failure of electricity.

7. Declaration/Affirmation

Solemnly affirm and declare as follows:

That I have read and understood the terms and conditions for the ‘Independent Associate’ of the Organization.
I have also gone through the company official website, printed materials, brochures and convinced about the business and I have applied for the Associate on my own volition.
I declare that I have not been given any assurance or promise by the Organization or by its associates as to any income on account of the program fees made by me. However, I am made to understand that I will be eligible for income/facilitation fees depending upon the volume of business done by me, as per terms and the Organization reserves the right to change the Business Plan at any point in time.
I undertake not to misguide or induce anyone to become an associate to join the Organization.
I hereby agree and adhere to the terms and conditions as stipulated along with the application form and as mentioned above to agree to join the program as a Candidate to do the business.
I hereby agree to submit all disputes to arbitration as provided in the terms and conditions of the Organization.
